MINUTES OF THE MEETING OF FOTHERBY PARISH COUNCIL HELD ON MONDAY 3 OCTOBER 2022 AT ST. MARY’S CHURCH.
 
Present: Cllr S Mansfield (Chairman), Cllr T Hunter, Cllr Wait, Cllr K Ensell, Cllr L Sutton and Cllr C Chen

Six Parishioners present
The meeting began at 19:25 hours with an open forum.
 
Parishioners reported that the wayside traffic marker on Church Lane had been dislodged. Cllr Ensell noted that he would replace the marker within days. In Peppin Lane, a branch overhanging the road had been removed by a parishioner. Thanks were given to Lee Smith for cutting the branch.
 
Cllr Mansfield advised that there was a need to refurbish of the parish noticeboard as it was falling into disrepair and leaking.

Apologies were received from ELDC Cllr Mossop.

117/22 APPROVAL OF THE MINUTES OF 5 SEPTEMBER 2022.
Cllr Wait proposed, seconded Cllr Ensell approval of the minutes of 5 September 2022. Cllr Mansfield signed the minutes.
 
118/22 CLERKS UPDATE.
 
Cllrs noted the resignation of Cllr Wait. Cllrs thanked Cllr Wait for his work over many years as a Cllr.

TO APPROVE ANY OTHER EXPENDITURE SUPPORTED BY A SUCCESSFUL PROPOSAL
Last year the parish council had presented a poppy wreath at the remembrance service. As this could be reused, it was proposed by Cllr Mansfield, seconded Cllr Sutton and approved by all Councillors to make a donation in lieu to the Royal British Legion for £20.
 
120/22. PLANNING
N 052 02126 21. LAND REAR OF STYLES FOTHERBY
The parish council noted that the application had been refused.
121/2022. FLOODING IN PEPPIN LANE AND ALLENBY CRESCENT
There was no update. Cllrs resolved to have a fresh determination to try to resolve the flooding matter once and for all. The clerk would contact Edward Mossop for an update. Anglian Water/LCC would also be contacted to better understand the source of the problem and the best route to resolution as it is understood to be a private drain on private land that might be blocked.
122/2022. UPDATE FROM FOTHERBY COMMON
Mrs Chester reported that stage 2 of work at common will begin Autumn/Winter. The tree surgeon will commence work soon. Cllrs noted that some of the trees planted in the first stage had not survived.
123/2022 LITTER STRATEGY
Cllr Ensell reported on an incident of fly tipping in Short Lane (West). Cllr Mossop is involved in enforcement here. The double gates had been secured with bolts at Elkington Lane West off the A16 to prevent further fly tipping. It was also reported that six empty drums of cooking oil had been fly tipped on the road towards Fotherby Common. These had been reported to ELDC for collection. There were proposals to get the cul-de-sac on Short Lane West gated to reduce both fly tipping and littering at this hot spot but to retain access for walkers and for legitimate vehicle access. Cllr Ensell is working with Cllr Mossop to achieve this via LCC.
124/2022. CONDITION OF ROAD FOTHERBY TOP
Cllr Ensell had contacted the Big Lottery and received a constructive response. A bid for funding above £10k cannot be progressed directly by the Parish Council as the land is not owned by the Parish Council. Previously the Parish Council had enquired with the land registry, but the owner was not registered. A bid by the Parish Council might be considered with the consent of the landowner. Cllr Ensell considered that there may be options to pursue a bid despite the landowner not being identified directly. Cllr Ensell would draft a letter to Lincolnshire County Council asking for permission to apply for a grant without prejudice where this did not commit the parish council or LCC to future liability for the road. Cllr Ensell noted that there is no guarantee of success here, but this option seemed a possible route to resolve the deadlock of many years. Cllr Ensell to draft a letter to LCC for Cllr Chen’s comments.
125/2022. HIGHWAYS. CUTTING OF TREES. ALLENBY CRESCENT
Clerk to resubmit the tree cutting at Bemrose Oaks to highways. Cllr Mansfield would supply a photograph.
 
Highways had responded that the overgrown hedges on the left-hand side when entering the village were the responsibility of the landowner. However, the parish council did not agree and would submit a photograph to highways showing the location of the hedge. Action: Clerk.
 
126/2022 BUS SHELTERS UPKEEP
Cllr Mansfield had repainted 2 shelters at each end of Allenby Crescent. An article would be put in the keyhole asking if any parishioners would volunteer to adopt a bus shelter to help with minor maintenance and cleanliness. The clerk was requested to contact Interskill (Louth) to ask for a quotation to repaint the remaining bus shelters and do some minor repairs. Action: Clerk to contact Interskill for a quotation.

The next meeting would take place on Monday 7 November 2022 at 7.30 pm.
 
128/2022 ANY OTHER BUSINESS
Discussion took place regarding the decision from Lincolnshire Wolds Railway to withdraw the permissive rights bridleway. Cllr Mansfield had contacted the railway for information. Lincolnshire Wolds Railway responded that they were planning to lay more track towards Louth and that the permissive bridleway is now closed for safety reasons as construction commences. Cllrs noted there was no evidence of recent activity on this part of the railway and no notices had been erected to date.
