MINUTES OF THE MEETING OF FOTHERBY PARISH COUNCIL HELD ON MONDAY 5 AUGUST 2024 AT 7.30 IN ST. MARY’S CHURCH
Present: Cllr Steve Mansfield (Chair), Cllr Lee Sutton, Cllr Kevin Ensell.
In attendance: Mrs Viv Davies (Clerk), ELDC Cllr E Mossop.
The meeting commenced with an open forum. 5 residents were present.
OPEN FORUM:
Cllr Mansfield reported that he had raised faults on Fix My Street on the following issues:-
Vegetation restricting Attenuation Tank Short Lane: LCC Highways had advised that no action will be taken. This will require further escalation owing to the role of the area in flood mitigation.
Top of Short Lane and Barton Street. Pole/ Dog Bin leaning: Awaiting response from LCC Highways.
Dangerous tree over Peppin Lane near Mawes Farm: Awaiting response from LCC highways.
Discussion took place on the delays in reinstatement of the white lines at the turning into Fotherby south after road resurfacing. Cllr Mansfield would raise a fault with LCC Highways
Questions were raised regarding the status of the Fotherby Sewage Pumping Station. Cllr Mossop reported that on 3 August, larger capacity pumps were installed in the wet well in Peppin Lane to transfer a higher volume of sewage from Fotherby to Louth sewage treatment works. The pumps at Utterby had also been synchronised to reduce flows to Fotherby wet well under storm conditions thereby maintaining sewerage services for residents in Allenby Crescent in future. AW has modelled the system and these modifications in flow rates should reduce the risk of both the Fotherby sewerage system being overloaded during storm conditions and sewage spills in Peppin Lane and Allenby Crescent. The system will need to be tested during the next storm to confirm the results anticipated from the recent works. In addition, a non-return valve would be fitted to one property in the area. Cllr Mossop had enquired with ELDC if the county council had powers to issue a formal notice against water companies. He had received a response that this had not previously been required.
A parishioner had emailed Cllr Hall about the A16 bypass traffic diverting via Fotherby. As Fotherby is the only diversion route a parishioner had suggested that a permanent speed prevention system be installed and maintained by highways. Cllr Mossop agreed to chase this matter with Cllr Hall.

Apologies were received from Cllr Christina Chen and Cllr Tim Hunter.

112/2024 APPROVAL OF MINUTES OF 1.7.24
Cllr Ensell proposed, seconded Cllr Sutton approval of the minutes of 1 July 2024. Cllr Mansfield signed the minutes.
113/2024 CLERKS UPDATE
Cllr Mossop had advised the parish council of the contact details of the person in ELDC who deals with Small Village Status to progress this matter.
A letter had been sent to Mr Ross, ELDC flood officer about the pumping capabilities of the Fotherby sewage pumps. The Fotherby pumps had been upgraded as advised in the open forum.
ELDC had been contacted to add The Laurels, Church Lane and Glebe Farm, Little Grimsby Lane onto the S19 Flood Prevention report. They had requested the email addresses for the properties. The clerk had written to the householders and with consent, provided the email address for one household to the flood prevention team.
114/2024 MATTERS ARISING FROM ACTION PLAN/MINUTES
Cllr Ensell has updated the Action Plan. Many actions had been completed and the action plan was in good health.
115/2024 FINANCE
Cllr Mansfield had verified the bank reconciliation. Cllrs noted the financial reports. Proposed Cllr Sutton, seconded Cllr Ensell approval of the cheques below.

116/2024 PLANNING APPLICATIONS: TO CONSIDER ANY NEW OR ONGOING APPLICATIONS
To Note
N/019/01685/21. Section 73 application in relation to condition no 5. (occupancy) and condition no 6 (register of occupancy). Erection of a large park-home style housing estate for the over 55s at Brackenborough Lawns at Courdeaux Corner. This had been refused and the applicant had taken it to appeal. Certain conditions connected to this appeal had not yet been met and so the request had not, at this stage, been formally accepted by the Planning Inspector.
The Chair would consider the Council response to any appeal, when we are notified, and then circulate it to Council members for their consideration before forwarding it to the Inspector.
117/2024 FLOOD RISK ITEMS:
FIELD DRAINAGE, REAR ALLENBY CRESCENT
A further letter has been written to the representative of the owner of the field behind Allenby Crescent. They had responded positively and that one of the properties had not reinstated the original boundary. The landowner continues to liaise with individual property occupiers, and it was expected that the works to improve drainage in the field would be completed by a contractor by the Autumn. This will reduce risks of surface water flooding in the gardens of properties in Allenby Crescent.
118/2024 FOTHERBY COMMON:
FOTHERBY COMMON UPDATE
The Parish Council noted that the lottery bid for funding had not met the requirements and had been rejected. Following discussion, other funding routes will be sourced and considered before the project is shelved. It was noted that whilst the project file was comprehensive, the Government Gateway was very restrictive as to what evidence could be submitted and limited the number of words significantly.
119/2024 LITTER STRATEGY & FLY TIPPING UPDATE
The Council had received an LCC consultation document updating their Lincolnshire Minerals and waste Local Plan, which will guide their thinking on this issue up to 2041. The Chair pointed out to members that the 129 page document, was now online, on the Lincolnshire County Council page. He would endeavour to consider this and also a council response from Fotherby. Any thoughts would be circulated to members before anything is sent forward to LCC.
Cllr Ensell would obtain a progress update from Cllr Hall on the request to erect a gate at Short Lane West. Littering continues to be significant in this turning space.
The parish council noted that there had been incidents of fly tipping of opened delivery parcels in North Elkington Lane and Short Lane West.
120/2024 VILLAGE ASSETS
The UK Grass Routes funding for grant application for a further SID had been rejected as we weren’t considered to be an accident blackspot.
Cll Ensell had updated the asset register. Proposed Cllr Mansfield, seconded Cllr Sutton and agreed by all councillor’s approval of the asset register.
Cllr Mansfield and Cllr Ensell had conducted a safety inspection of village assets in late July. Signed copies of inspections were filed by the Clerk for future reference. There were no matters of safety identified during inspections. There were a few minor matters that needed maintenance. A list has been prepared on which a quotation will be obtained. Overall, village assets are in good state of repair and have improved in the since the initial inspection in 2022. Cllr Mansfield would obtain quotations.
As part of the inspection, the flower box on the south end of Main Rd has reached end of life and needs to be repositioned away from the brow of the hill for ease of maintenance of plants. Cllr Mansfield would ask Cllr Hunter review options for replacement.
Cllr Mansfield noted that maintenance at the Dock Garden would re-commence.
Cllr Mansfield had also left a message with regarding cutting the hedge near the Menage as several villagers had commented upon clipping their wing mirrors on overhanging hedgerow.
Pride in Lyndsey team had been contacted to do further maintenance works around end of N.Elkington Lane and Short Lane West. The pavement near Style Furniture is also on the list to allow better access for pedestrians.
Following discussion, the Parish Council would write allotment holders regarding the condition of allotment hedges and the need to maintain these in good order during the growing season. Cllr Mansfield would draft a letter.
DOG BIN CLOSE TO MAWER'S FARM, PEPPIN LANE.
Following a request to ELDC Cleansing Team regarding dog bins the Parish Council were awaiting costings. Proposed Cllr Sutton, seconded Cllr Ensell to accept an offer by Cllr Mossop to approach the ELDC to ask simply for the removal of the dog bin and post from the Dock area, as there was already a bin close by, opposite the end of Short Lane. This bin with a new post would be erected at the Peppin Lane railway crossing. The dog bin at Mawer’s Farm can remain as it is.
This was agreed.
GRASS CUTTING
Cllr Ensell had consolidated the contracts ahead of the re-let in April 2025. A further amendment was required to exclude gardening at the dock. A revised contract will be sent to the Clerk for quote(s) to be received. It was noted that maintenance of the dyke below Laxfield in Church Lane was also included to lessen the risk of flooding in this area in future.
