FOTHERBY PARISH COUNCIL
MINUTES OF THE MEETING OF FOTHERBY PARISH COUNCIL HELD ON MONDAY 6 JULY 2026 AT 7.30 PM IN ST. MARY’S CHURCH
Present: Cllr Tim Hunter (Vice Chair, and Chairman of the meeting), Cllr Kevin Ensell, Cllr Lee Sutton,
In attendance: Mrs. Viv Davies (Clerk), LCC Cllr N Hastings, ELDC Cllr E Mossop.

OPEN FORUM:
Cllr Mansfield had sent the following report.
Cllr Mansfield had arranged removal of a dead badger in the water butt by the old post office bus stop after being contacted by a parishioner.
Allotment 4 had been let to the existing allotment holder of allotment 5 who is in the process of clearing the overgrown site.
Lincolnshire Rights of Way had been contacted regarding the wobbly post on the bridge and overgrown path through from Mawer’s Farm to Church Lane. The post will be repaired by the landowner.
77/2026 APOLOGIES FOR ABSENCE
Apologies were received and accepted from Cllr S Mansfield (Chairman). Cllr Chen was absent.
78/2026 DECLARATIONS OF INTEREST – TO BE STATED IN ANY PROPOSITION
Cllr Ensell advised that whilst employed by Anglian Water, he did not have any input into decisions relating to planning applications received into the business.
79/2026 APPROVAL OF MINUTES OF 1.6.26
Proposed Cllr Ensell, seconded Cllr Sutton to approve the minutes of 1.6.26. Cllr Hunter signed the minutes.

81/2026 MATTERS ARISING FROM ACTION PLAN/MINUTES
DEFIBRILLATOR
The Fotherby Jubilee Committee would update the parish council when further information is available regarding the costs to maintain the defibrillator. The Parish council pointed out that it would be helpful to have forecast costs prior to the budgeting process for the following financial year which takes place in October/November.

Cllr Mansfield had verified the bank reconciliation. Cllrs noted the financial reports.

TO APPROVE FURTHER ITEMS OF EXPENDITURE
Councillors noted that the HMRC mileage rate had increased from 45p per mile to 55p per mile with effect from 1 April 2026. Proposed Cllr Hunter, seconded Cllr Ensell to approve the increase in mileage with effect from 1 April 2026 (Back pay of £11.92).
83/2026 FLOOD RISK ITEMS
Due to the lack of rain, there were no further incidents of flooding to be reported and recorded on the flood log during the past month.
84/2026 PLANNING APPLICATION
Mawers Farm Peppin Lane Fotherby Lincolnshire LN11 0UW: Ref. No: 00979/26/FUL - Extensions and alterations to existing dwelling, which is a listed building to provide additional living accommodation.
Ref. No: 00980/26/LBA| Listed Building Consent - Extensions and internal and external alterations to existing dwelling to provide additional living accommodation and partial demolition of existing dwelling.
The Parish Council noted that ELDC Heritage Officers had not been informed of this application. They have now been contacted and will be assessing this and the Listed Building Application which only appeared on the planning portal after the Parish Council had notified the Heritage officer. Following discussion, the Parish Council had no comments to make.
Ref. No: 00929/26/FUL - Extension to existing dwelling to provide additional living accommodation. The parish council had no comment.
Land Rear of Style Furniture Main Road Fotherby Lincolnshire
Ref. No: 00885/26/RVC. Section 73 application to vary condition 2 (approved plans) previously imposed on N/052/02126/21 for change of use of the land for the siting of 18no. static caravan/lodges (for holiday purposes only).
The parish would submit the following comment.
In a previous application for an additional property to be built on an existing plot in Short Lane, it was noted that Anglian Water did not permit connection to the foul sewerage system owing to the foul water system being at capacity. We would expect Anglian Water to take a similar stance with this application in not connecting to the public sewer given that it has been stated that there is insufficient capacity. Inspector’s Report (from appeal) – Schedule of Conditions /Section 8.
‘All foul water from the development hereby approved must be collected and discharged into the Mains sewer network. If it is found that there is insufficient capacity in the existing system then an alternative scheme for the discharge of foul water must be submitted to and approved in writing by the Local Planning Authority and that scheme must be fully implemented before the development is brought to use.’
Anglian Water advised (in the planning application for Short Lane) that the system cannot cope with any more discharge and has reached capacity.
The parish council had no comment relating to vary condition 2 (approved plans) previously imposed on N/052/02126/21 for change of use of the land for the siting of 18no. static caravan/lodges (for holiday purposes only).
The parish council would like to clarify the position regarding residency of the units within any 12-month period. Cllr Mansfield had written for clarification on this issue.
Land Off Allenby Crescent Fotherby Lincolnshire. Ref. No: 00882/26/FUL. Erection of a dwelling and detached double carport.
The Parish Council would submit the following comment.
The Parish Council noted that there would be issues posed as access to the site will be required by large vehicles during construction and that there are tight bends and parked cars in both directions in Allenby Crescent. The Parish Council considered that should the application be granted this should be this subject to a condition that all construction traffic for the site access should be from the North and that temporary signage be placed to the South preventing HGV Access.
The Parish council assume that the Environment agency will be fully consulted about discharge of the package sewage treatment unit.
85/2026 LITTER STRATEGY & FLY TIPPING UPDATE
Litter picking continues. Thanks were given to Cllr Ensell and the litter picking volunteers across the village and beyond. The parish council noted that the majority the litter signage had disappeared.
Cllr Ensell would write a letter to Cllr Brookes regarding concerns regarding the risk of increase of fly tipping in and around Fotherby should there be an implementation of an appointment system for the Louth Recycling Centre.
86/2026 VILLAGE ASSETS
Cllr Mansfield had erected signs to ban overnight parking at Fotherby Common.
Maintenance items provided for in the budget would be considered at the next meeting.
The Flood and Water Team at LCC had responded that the water system at Fotherby Dock is not documented as part of the highways flooding records.
