FOTHERBY PARISH COUNCIL
MINUTES OF THE MEETING OF FOTHERBY PARISH COUNCIL HELD ON MONDAY 7 SEPTEMBER 2026 AT 7.30 PM IN ST. MARY’S CHURCH
 
Present: Cllr Steve Mansfield (Chairman), Cllr Tim Hunter (Vice Chair), Cllr Kevin Ensell, Cllr Christina Chen.
 
In attendance: Mrs. Viv Davies (Clerk), ELDC Cllr E Mossop, LCC Cllr N Hastings.

OPEN FORUM:
 
Discussion took place regarding the current position of the foul water system relating to new planning applications. A resident raised the issue of the planning application at Style Furniture and gave some comprehensive feedback on recent research. It was noted that Anglian Water had now resolved that they cannot support connection of the Style development to the foul water system at this site based upon the current 2026 status of the wastewater system. The resident had emailed the planning department regarding this updated statement from the Anglian Water. However, the LPA confirmed that the planning department have advised that the planning inspectorate conditions imposed are legally binding. This decision had been based on the capacity of the wastewater system in 2022.
 
The Parish Council noted that Fotherby now had the prospect of 18 further lodges being connected to the foul water system thereby increasing the loading on this “at capacity” system thereby increasing the risks of foul water flooding in the village. The resident suggested that the Parish Council lodges a formal complaint via ELDC Corporate Complaint to challenge the planning department’s current position. To allow Councillors time to digest the information provided, the issue of the wastewater flooding and the strategy for future planning applications would be an agenda item at the October 2026 meeting. The Chairman and Councillors thanked the resident for the time he had taken to research and present the information to the Council.
 
Cllr Mansfield had received a response from Planning Liaison at Anglian Water. The Parish Council noted that if an application to discharge the relevant condition for this 2022 granted permission were submitted today to Anglian Water for comment, they would not recommend that any connection be made to the foul system due to capacity constraints within the network and terminal pumping station. This is because of the increased risk of potential incidents of hydraulic flooding at Fotherby. The alternate provision of on-site treatment of wastewater and discharge to the surface water system would be required. This outcome would align with Anglian Water’s condition to include an on-site waste water treatment unit at the Short Lane development that was recently approved by ELDC Planning Department.
 
Cllr Mossop agreed to research the interpretation of the implementation of the condition relating to this planning application and advise the parish council in support of their next steps.
 
Cllr Mansfield had requested to meet with the Chairmen of Utterby and Ludborough Parish Councils in the coming weeks. Central to discussions will be for all parish councils to liaise on any planning applications in their respective parishes as any additional properties in Utterby, Ludborough or Fotherby would increase the risks of foul water flooding and sewage spills to the environment within the catchment.
 
A resident asked about the planning application at Mawer’s Farm and the related public footpath. The proposed diversion is considered to be temporary to ensure safety of the public during renovation works on the property.
 
Cllr Mansfield advised that the hedges at the allotments would be cut in the coming weeks to support allotment holders and to ensure empty plots are managed correctly.
 
A gardener has been appointed to work 3 hours per month in the summer season at Fotherby Dock to help maintain the gardens.
 
Following discussion and confirmation that the Dock is the property of LCC, Cllr Mansfield would send a letter to LCC regarding the condition of Fotherby Dock, the extent of bullrush growth and for LCC to consider any impact on the risk of surface water flooding.

101/2026 DECLARATIONS OF INTEREST – TO BE STATED IN ANY PROPOSITION
There were no declarations of interest. Cllr Mansfield noted his interest in the Fotherby Jubilee Committee and therefore the defibrillator.
 
102/2026 APPROVAL OF MINUTES OF 3.8.26
 
Proposed Cllr Ensell, seconded Cllr Hunter to approve the minutes of 3.8.26. Cllr Mansfield signed the minutes.

104/2026 MATTERS ARISING FROM ACTION PLAN/MINUTES
 
DEFIBRILLATOR
 
It was further noted that the Parish Council had agreed at the August 2026 meeting to adopt the maintenance and any necessary replacement of the village defibrillator sited at Fotherby House from April 2027.
 
105/2026 FINANCE
Cllr Mansfield had verified the bank reconciliation. Cllrs noted the financial reports. Cllr Ensell, seconded Cllr Hunter approval of the cheques below.

106/2026 FLOOD RISK ITEMS
 
There were no further incidents of flooding to be reported and recorded on the flood log during the past month despite some periods of moderate rainfall after the long hot summer and dry spell.
 
107/2026 PLANNING APPLICATIONS
 
Mawer’s Farm Peppin Lane Fotherby Lincolnshire LN11 0UW: Ref. No: 00979/26/FUL - Extensions and alterations to existing dwelling, which is a listed building to provide additional living accommodation. This was still under consultation from the heritage association as this is a listed building.
 
Ref No: 00229/26/FUL. Louth Rd Planning Permission - Erection of 5no. dwellings, construction of a vehicular accesses, internal access road and erection of a field gate. Land East of Louth Road Fotherby Lincolnshire. There was no decision. The Parish Council noted comments from LCC archaeology that are listed on the portal
 
Ref No: 00882/26/FUL Allenby Cres Planning Permission - Erection of a dwelling and detached double carport -land Off Allenby Crescent Fotherby Lincolnshire. Received: Fri 29 May 2026. Validated: Fri 19 Jun 2026. Status: Awaiting decision. Due to the geometry of Allenby Close a construction management plan has been requested. LCC Archaeological have recommended that the applicant submits, prior to the application, a Heritage Impact Assessment (HIA) for the site which should also include the results of a geophysical survey.

108/2026 LITTER STRATEGY & FLY TIPPING UPDATE
 
Litter picking continues across the village and nearby lanes to maintain standards. There had been several fly tipping incidents outside the village notified by a diligent resident which were reported to ELDC Cleansing and FlyTipping teams for collection
 
109/2026 VILLAGE ASSETS
 
The annual safety & condition inspection would be conducted in the coming weeks
 
An additional Keter store would be purchased for sandbag storage.
Bus Shelter Repairs. Refurbishment of Bus Shelter 2 had been completed.
Cllr Mansfield would seek suitable quotes for the recoating of Bus Shelter 1.
The Parish Council noted that bus shelter no 5 had been vandalised. This had been repaired by Cllr Ensell and was thanked for his work.
 
109/2025 SPEEDING.
 
Cllr Mansfield had written to Kyra Nettles at ELDC highways suggesting various options to reduce speeding. A response had been received and was tabled at the meeting. The Council noted their extreme disappointment in the response in that virtually no action would be taken to support speed reduction initiatives proposed by the Council. Next steps would be considered given the disappointing response.

Cllrs agreed that the December meeting would be moved to Monday 30 November 2026.
 
111/2026
 
The Clerk would write to bush landscaping noting that it had been reported that the team had been seen failing to wear appropriate PPE as defined in their risk assessments; that is suitable ear and eye protection during mowing and strimming works. A request to ensure protection of the team would be made.
